We have recently received communication from the FRA concerning the correct way to treat an employee who works one shift in covered service and then is available for a later shift in non-covered service. It is advised that an employee in this situation will have to have required minimum rest both before and after the HOS covered shift; otherwise, the FRA applies the co-mingled provision of the regulation and would consider the second non-covered shift as co-mingled with the first covered shift if those shifts were not separated by 10 hours of rest. This approach is consistent with the FRA's treatment of the co-mingled provision for TE&Y employees.
The Rail Safety Improvement Act (RSIA) Mechanical Q&As have been modified to reflect this updated information.
