Agreement - Same-Sex Spouses and Defense of Marriage Act (DOMA)
Health and Welfare benefits for agreement employees and eligible dependents are provided under the Railroad Employees National Health and Welfare Plan and the NRC/UTU National Plan. These Plans are maintained pursuant to collectively bargained agreements (CBAs) binding on Union Pacific that are negotiated on a national level between representatives of all the major railroads and railroad unions. The Plans have never covered same-sex spouses, and we have been advised that nothing in the Supreme Court's recent decision regarding the federal Defense of Marriage Act (DOMA) requires any expansion of the population that our Plans cover. Accordingly, absent agreement on a national level between the carriers and labor, no change in current Plan coverage is anticipated at this time.
